[Chapter I: General Provisions]

Article 1: Definitions

In these Conditions of Carriage,

  • "Domestic Carriage" means carriage by air performed by the Carrier, gratuitously or for reward, in respect of which, under a contract of carriage, the place of departure and the destination, or other agreed stopping place(s) are all situated in Japan.
  • "Carrier" means, AIRDO Co., Ltd.
  • "Carrier's Office" means a Carrier's office (including a city office and an airport office), a local office of a sole agent or agent(s) designated by the Carrier and/or the Carrier's web page on the Internet.
  • "Ticket" means such form of electronic document as is recorded in the Carrier's database (hereinafter referred to as an "Electronic Ticket") or a paper ticket issued by the Carrier's Office for the carriage of passengers on the Carrier's domestic lines, pursuant to these Conditions of Carriage.
  • "Authentication Code" means a code that can prove that the passenger has an Electronic Ticket, such as a confirmation number, a credit card number that was used for payment and/or any other number designated by the Carrier.
  • "Exchange Order" means a document issued by any Carrier's Office in exchange for which a Ticket shall be issued to the person named therein.
  • "Stopover" means such deliberate interruption of a trip by a passenger, at any point between the place of departure and the destination, as is agreed to in advance by the Carrier.
  • "Overbooking" means the practice of accepting more reservations than the number of seats available on some flights in order to provide seats that are expected to be available to customers who actually wish to fly.
  • "Baggage" means such articles, effects and other personal property of a passenger that constitute either Checked or Unchecked Baggage, unless otherwise specified.
  • "Checked Baggage" means such Baggage that the Carrier takes custody of and for which it issues a Baggage Identification Tag (the Baggage tag that is attached by the Carrier to a particular article of Checked Baggage and the Baggage claim stub that is given to the passenger).
  • "Unchecked Baggage" means such Baggage other than Checked Baggage that the Carrier has permitted a passenger to carry into the cabin.
  • "Baggage Identification Tag" means a document issued by the Carrier solely for the purpose of identification of Checked Baggage, which consists of two portions: the Baggage tag that is attached by the Carrier to a particular article of Checked Baggage and the Baggage claim stub that is given to the passenger.
  • "Excess Baggage Ticket" means a document issued by the Carrier for carriage of Baggage in excess of the applicable free Baggage allowance specified by the Carriage.

Article 2: Application of Conditions

  1. These Conditions of Carriage shall apply to the Domestic Carriage of passengers and Baggage, together with any incidental services provided by the Carrier.
  2. Carriage of passengers shall be subject to these Conditions of Carriage and any regulations provided for under such Conditions in effect on the day the passenger boards the aircraft.
  3. Should any special agreement be made with respect to a particular provision of these Conditions of Carriage, such special agreement shall apply, notwithstanding the aforementioned provision.

Article 3: Change in Conditions of Carriage and/or Relevant Regulations

The Carrier may change, modify or amend any provision of these Conditions of Carriage or the regulations established under the Conditions; provided that such change, modification or amendment shall be notified by posting on its website or in any other appropriate manner for a reasonable period of time.

Article 4: Publication

Passenger fares, Excess Baggage charges, other fees and charges, timetables and other necessary information shall be published together with these Conditions of Carriage at any Carrier's Office.

Article 5: Consent of Passengers

Passengers shall be deemed to have acknowledged and given consent to these Conditions of Carriage and the rules and regulations established under these Conditions.

Article 6: Governing Law and Jurisdiction

  1. These Conditions of Carriage shall be construed in accordance with the laws of Japan, and any matter not provided for in these Conditions of Carriage shall be subject to the laws of Japan.
  2. Any dispute arising out of, or in connection with, these Conditions of Carriage shall be subject to the jurisdiction of Japanese courts and legal proceedings therefor shall be governed by the laws of Japan, no matter who is entitled to claim for damages or what the legal basis for such claim is.

Article 7: Instructions of Carrier's Agent

Passengers shall observe the instructions of the Carriers' agent with respect to boarding, deplaning, and/or any other acts at airports or on board, or with respect to places of loading or unloading of the passenger's Baggage.

[Chapter 2: Carriage of Passengers]

[Section 1: Tickets]

Article 8: Issuance and Validity of Tickets

  1. The Carrier shall issue, at a Carrier's Office, an Electronic Ticket, a paper Ticket or an Exchange Order (hereinafter referred to as the "Issuance of a Ticket") upon receipt of payment by the passenger of such applicable fares and/or charges as separately stipulated by the Carrier. A passenger shall provide the Carrier his/her name, age, sex, and any contact information such as a telephone number that the Carrier may use to communicate with the passenger.
  2. A Ticket or Exchange Order may be used only by the passenger who is named on such Ticket or Exchange Order and shall not be transferred to a third party.
  3. A Ticket shall be invalid, unless the passenger uses it in accordance with the information prerecorded in the electronic database of the Ticket (or in the case of a paper Ticket, as described on the Ticket) (hereinafter referred to as "Reservations Data").
  4. In order for the Carrier to confirm the validity of a Ticket, the passenger will be requested to present or declare his/her Authentication Code, or present his/her paper Ticket or Exchange Order (hereinafter referred to as "Presentation of Authentication Code or Ticket").
  5. A passenger must present a valid Authentication Code, Ticket or document stipulated by the Carrier, which is duly issued in accordance with the Carrier's regulations and valid for the flight which he/she is actually to board. When a passenger fails to do so, the Carrier may refuse carriage of such passenger.

Article 9: Period of Validity

  1. A passenger's Ticket that contains in its Reservations Data the flight that the passenger is scheduled to board, shall be valid for that flight exclusively.
  2. A passenger's Ticket that does not contain in its Reservations Data the flight that the passenger is scheduled to board, shall be valid on the date of issuance of such Ticket and for 1 year from the following day, unless otherwise provided for by the Carrier, with respect to a Ticket to which the Carrier applies a special fare.
  3. The preceding two paragraphs shall apply mutatis mutandis to Exchange Orders. However, an Exchange Order containing in its Reservations Data the flight that the passenger is scheduled to board shall be exchanged for a Ticket for such flight not later than the scheduled boarding day. An Exchange Order that does not contain in its Reservations Data the flight that the passenger is scheduled to board, shall be exchanged for a Ticket within 90 days, calculated from the day following the date of issuance of such Exchange Order.
  4. A passenger's Ticket shall become invalid unless the passenger boards a flight on or before the expiry date of the period of validity of the Ticket.

Article 10: Extension of Validity

  1. If a passenger is prevented from traveling within the period of validity of a Ticket or Exchange Order by reason of his/her illness or for any other reason, or if the Carrier is unable to provide a previously confirmed seat on the flight or make a seat available for reservation within the validity of a Ticket or Exchange Order, the validity of the Ticket may be extended for only 30 days, from the day following the expiry date of the period of validity of the Ticket or Exchange Order originally issued.
  2. If the period of validity of a Ticket is extended pursuant to the preceding paragraph, a Ticket or Exchange Order held by any person accompanying the passenger holding the Ticket may likewise be extended.

Article 11: Seat Reservations

  1. A passenger shall make a seat reservation for a flight in order to board the Carrier's flight.
  2. The Carrier will accept applications for seat reservations, at the earliest, more than 2 months prior to the scheduled date of the flight at the Carrier's Offices, unless otherwise provided for by the Carrier with respect to a passenger paying a special fare.
  3. If a passenger makes a seat reservation after the issuance of a Ticket, he/she shall present his/her Authentication Code or Ticket and shall provide necessary information to have them recorded in the Carrier's database (or in the case of a paper Ticket, shall provide the necessary information to have them entered on the face of the Ticket).
  4. In order to cancel or change a seat reservation, the passenger shall present his/her Authentication Code or Ticket to the Carrier. The reservation made to a passenger shall be non-transferable.
  5. Notwithstanding the preceding three paragraphs, the Carrier may accept, at a Carrier's Office separately designated, an application for a seat reservation or its cancellation, or change in a seat reservation, without the Authentication Code or Ticket being presented.
  6. A seat reservation made pursuant to the preceding paragraph shall not be confirmed unless the passenger presents the Authentication Code or Ticket to the Carrier not later than the time limit specified by the Carrier for the purchase of the Ticket. Should the passenger fail to present the Authentication Code or Ticket by such time, the Carrier may cancel the seat reservation and any onward reservations, without prior notice.
  7. In cases where paragraph 2 of Article 20 applies, the Carrier may cancel any onward reservations made subsequent to such reservation.
  8. AIRDO prohibits acts of reservations not intended for actual boarding.
  9. The Carrier may, at its own discretion, cancel all of or a portion of a passenger's reservation if two or more seats are reserved for the same passenger and if.
    • (1) the reservations are made for the flight or flights of the same sector of which each scheduled time of departure is the same or in proximity to each other.
    • (2) it is reasonably considered that the passenger can not use all of reserved seats.

Article 12: Seat Assignment

The Carrier may, without a prior notice, change the seat assigned by a passenger due to a ship change or other reason. Such change shall include a change in seat position, seat type and specification.

Article 13: Check-in Time

  1. A passenger shall arrive at the time and place stipulated by the Carrier in order to complete the necessary departure procedures before boarding an aircraft.
  2. The Carrier may refuse boarding by a passenger who fails to arrive by the time stipulated by the Carrier, as provided for in the preceding paragraph.
  3. The Carrier shall not delay a flight for any passenger who fails to arrive by the time stipulated by the Carrier pursuant to paragraph 1.

Article 14: Refusal and Limitation of Carriage

  1. The Carrier may refuse carriage of, or remove at any stopping place, any passenger, (upon such refusal or removal, excluding sub-paragraph (5) through (7) of this paragraph, the Carrier shall make a refund to the passenger pursuant to paragraph 1 of Article 22 and shall not collect cancellation charge) and in such case, handle his/her Baggage accordingly, if the Carrier deems that the passenger falls under any of the following:
    • (1) such action is necessary for flight safety;
    • (2) such action is necessary in order for the Carrier to comply with applicable laws or regulations, or governmental requirements;
    • (3) the passenger, because of his/her conduct/behavior, age, mental or physical condition:
      • (a) requires special assistance by the Carrier, which exceeds legal requirements or would cause an undue burden on the carrier's normal procedures;
      • (b) is seriously injured or ill, or is an unaccompanied child under the age of eight years;
      • (c) carries any of the items specified below:
        weapons (excluding those carried by competent officers on duty), gunpowder, explosives, corrosive items, inflammable items, or other articles which are likely to cause a hazard or risk to the aircraft, passengers, and/or any loaded property, or articles or live animals inappropriate for carriage by aircraft;
      • (d) may cause discomfort or trouble to other passengers;
      • (e) may cause harm to the safety or health of himself/herself or other persons;
      • (f) may cause harm to an aircraft or any property;
      • (g) falls under the provisions of paragraph 4 or 5 of Article 27;
      • (h) obstructs any Carriers' staff, agent and crewmember of the Carrier from performing his/her duties or fails to comply with Baggage-any instruction of such crewmember;
      • (i) displays conduct that is unlawful, disorderly, obscene or violent;
      • (j) uses a portable telephone, portable radio, electronic game or other electronic device in an aircraft cabin without the Carrier's permission;
      • (k) smokes in an aircraft cabin, including the use of all smoking devices;
      • (l) have or may have an infectious disease that poses a direct threat to the health and safety of Carriers' staff, agent and crew member or other passengers;
      • (m) refuses to take any action that the Carrier requires of the passenger as a precautionary measure against infectious diseases;
      • (n) is deemed the significant influence of alcohol or drugs;
      • (o) may be significantly offensive or objectionable to other passengers, including the passenger's hygiene;
    • (4) has behaved on a previous flight in a manner that falls under sub-paragraph (3) of this paragraph, and the Carrier deems that such conduct/behavior is possible to be repeated;
    • (5) the Ticket presented by the passenger is:
      • (a) acquired unlawfully or purchased from an entity other than the issuing the Carrier or Agent,
      • (b) reported to have been lost or stolen,
      • (c) a counterfeit Ticket, or
      • (d) altered by a person other than a Carrier or Agent, with respect to any Ticket thereof, in any of which cases the Carrier reserves the right to retain the Ticket;
    • (6) the person presenting a Ticket cannot prove that he/she is the person named in the "Passenger Name" box of the Ticket, in which case the Carrier reserves the right to retain such Ticket; or
    • (7) the passenger fails to pay any applicable fares, charges or taxes or may fail to perform a credit arrangement agreed upon between the Carrier and the passenger (or the person paying for the Ticket).
    In the cases mentioned in sub-paragraph (3)(e) ,(f) ,(h) or (i) of this paragraph, the Carrier may take, in addition to the measures mentioned above, such other measures as the Carrier deems necessary to prevent the passenger from continuing such conduct, obstruction or act. These measures shall include, but are not limited to, restraint of the passenger.
  2. If the Carrier transports a passenger whose status, age, or mental or physical condition may pose a hazard or risk to himself/herself, then the Carrier shall not be liable for any death, injury, illness or disability suffered by that passenger or the aggravation or consequences thereof due to that status, age, or mental or physical condition.
  3. Acceptance of Carriage of unaccompanied Children or Infants, disabled persons, pregnant women or persons with illness shall be subject to the Carrier's Regulations and may require a prior arrangement with the Carrier.
  4. If the total weight of the passengers boarding, and/or Baggage loaded in, an aircraft may exceed the maximum allowance weight with respect to the aircraft, the Carrier may, in accordance with the Carrier's Regulations, decide which passengers and/or Baggage will be carried.
  5. To ensure assistance in emergency evacuation, the Carrier may prevent a passenger from taking an exit row seat of the aircraft and change his/her seat to another seat (upon which change, if the exit row seat is a special seat, the Carrier shall refund the special fare applied to the seat by the Carrier and shall collect no cancellation charge), if the Carrier determines at its reasonable discretion that the passenger falls under any of the following subparagraphs.
    • (1) the passenger is under the age of 15.
    • (2) the passenger has any difficulty in assisting in emergency evacuation, or may cause any harm to his/her health if he/she assists in emergency evacuation due to his/her physical condition, health or for other reasons.
    • (3) the passenger can not understand evacuation procedures and crew's instructions.
    • (4) the passenger does not consent to providing assistance in emergency evacuation.

Article 15: Loss of Paper Ticket

  1. If a passenger loses his/her paper Ticket, the passenger shall be required to purchase a new Ticket for the sector that the lost Ticket covers.
  2. If, in the case of the preceding paragraph, the loss of the Ticket is reported to a Carrier's Office (excluding the Carrier's web page, hereinafter the same shall apply) on or before the expiry date of the refund period provided for in Article 21, the Carrier shall issue a refund (upon such refund, the Carrier shall collect the refund charge set forth in paragraph 1 of Article 20) in the manner set forth below, provided that: the lost Ticket is presented on or before the expiry date of the effective period for refund (within 3 months from the day following the expiry date of the refund period, hereinafter the same shall apply); or the Carrier has confirmed as a result of an investigation conducted after the expiry of the effective period for refund that neither the lost Ticket has been used during the effective period set forth in Article 9 nor that a refund has been made by the expiry date of the refund period.
    • (1) If the passenger has not purchased a replacement Ticket, the Carrier shall refund the fare and relevant charges paid for the lost Ticket: provided, however, that if a cancellation charge set forth in paragraph 2 of Article 20 is applicable, the Carrier shall collect such cancellation charge as well as the prescribed refund charge.
    • (2) If the passenger has purchased a replacement Ticket, the Carrier shall refund the fare and relevant charges for the replacement Ticket, unless otherwise provided for by the Carrier.
    • (3) If, in the case of sub-paragraph (1) or (2) above, the passenger has canceled the portion of trip covered by the lost Ticket, the Carrier shall issue a refund pursuant to the provision of Article 20.
  3. The preceding two paragraphs shall apply mutatis mutandis to a lost Exchange Order.
  4. If, in the case of the preceding two paragraphs, the Carrier determines to issue a refund as a result of an investigation conducted after the expiry of the effective period for refund, the Carrier shall collect, in addition to the prescribed refund charge and cancellation charge, an investigation fee of 2,060 yen per Ticket flight coupon or Exchange Order coupon and 1,030 yen per charge slip.

[Section 2: Fares and Charges]

Article 16: Fares and Charges

  1. Fares and charges, conditions of their application and other conditions are shown in the Carrier's passenger tariff table for each type of fares and charges as separately stipulated by the Carrier.
  2. Fares shall apply to carriage from the airport at the place of departure to the airport at the destination.
  3. Fares and charges shall include consumption tax (including local consumption tax).

Article 17: Applicable Fares and Charges

  1. Applicable fares and charges shall, unless otherwise provided in Carrier's regulations, be those in effect as of the date of issue and applicable on the date the passenger is scheduled to board the aircraft.
  2. If any fares and/or charges collected by the Carrier are not equivalent to the applicable fares and/or charges, the difference shall be refunded or collected by the Carrier, as the case may be, unless otherwise provided in Carrier's regulations with respect to any passenger paying a special fare and/or charges.

Article 18: Carriage of Infants Free of Charge

The Carrier will accept carriage free of charge of 1 non-seat occupying passenger under 3 years of age (hereinafter referred to as an "Infant"), provided the infant is accompanied by 1 passenger of 12 years of age or over.

Article 19: Changes Requested by Passenger

Of the Reservations Data on a Ticket or any data specified in an Exchange Order (hereinafter referred to as the "Reservations Data of a Ticket or Exchange Order"), any change in the date, time, flight, sector, routing, or destination requested by the passenger shall be effected in accordance with the applicable conditions separately stipulated by the Carrier for each type of fare and charges. For those fares and charges where a change requested by a passenger is permitted, changes shall be effected only when such request is made at a Carrier's Office during its business hours and prior to the scheduled departure time of the original flight, pursuant to the following. Such change, however, is subject to the availability of a seat on the flight that the passenger desires to board. The passenger shall present to the Carrier's Office the Authentication Code or Ticket when requesting for a change.

  • (1) The Carrier shall refund, or collect, as the case may be, any difference between the amount of fare and charges applicable to the whole sector affected by the change and the amount of fare and charges already paid.
  • (2) The fare and charges applicable after such change shall, unless otherwise provided in Carrier's regulations, be those which, as of the date of original issue, were intended to apply on the date the passenger desires to board.
  • (3) The period of validity of the Ticket for which change is effected shall be the period of validity applicable as of the date on which the Ticket originally purchased was issued.
  • (4) No cancellation charge set forth in paragraph 2 of Article 20 shall be collected by the Carrier for the cancellation of a reservation for the original flight due to such change.
  • (5) If any charge becomes, or ceases to be, applicable due to the change, the Carrier shall collect, or refund such charge, as the case may be.

Article 20: Voluntary Refund, and Refund/Cancellation Charges

  1. In the case of a refund for a Ticket or an Exchange Order requested by a passenger, the amount of refund shall be: if the entire portion of the itinerary is to be refunded, the total amount of the fare and charges paid; and if a part of the itinerary is to be refunded, an amount equal to the difference between the fare and charges paid, and the fare and charges applicable to the portion of the itinerary for which the Ticket or the Exchange Order has been used. Upon such refund as prescribed above, unless otherwise specifically provided in Carrier's regulations, the Carrier shall collect from the passenger 440 yen as a refund charge per sector specified in the Ticket or Exchange Order.
  2. In the case of a refund for a Ticket or Exchange Order for which a seat has already been reserved pursuant to the provision of the preceding paragraph, a cancellation charge shall be collected in accordance with the Carrier's passenger tariff table for each type of fares and charges as separately stipulated by the Carrier.
  3. If the total amount of the fare and charges paid is less than the total amount of the refund charge and cancellation charge payable pursuant to each of the preceding two paragraphs, the total amount of refund and cancellation charge shall not exceed the amount of the fare and charges paid.

Article 21: Refund Period

Any refund of a fare or charges shall be made in exchange for the surrender of a Ticket or an Exchange Order by not later than 30 days from the day following the expiry date of the period of validity of such Ticket or Exchange Order.

Article 22: Involuntary Changes and/or Cancellation Caused by Carrier

  1. If the Carrier fails to perform a contract of carriage, in whole or in part, for any reasons other than those requested by a passenger and except for those set forth in paragraph 5 of Article 40 (hereinafter referred to as an "Involuntary Change or Cancellation Caused by Carrier"), the Carrier shall, at the passenger's option, follow one of the below (1), (2), or (3) procedures. However, the Carrier may, in accordance with the Carrier's regulations, handle such matters in accordance with paragraph 2 of this Article.
    • (1) The Carrier will have the option of providing either of the following to carry the passenger and his/her Baggage to the first destination of the Reservations Data on the Ticket or Exchange Order.
      • (a) on a flight of the Carrier on which a seat is available.
      • (b) on a flight of any other carrier on which a seat is available.
      • (c) by other means of transportation.
        In the cases set forth above, if an amount of fare and charges after the change of flight or rerouting exceeds the amount that would have been refunded for the applicable fare and charges of the original sector, the Carrier shall not collect the difference. If such amount is less than the amount that would have been refunded, the Carrier shall refund the difference, unless otherwise provided for by the Carrier with respect to a particular Ticket or Exchange Order;
    • (2) The Carrier shall issue a refund as follows: before commencement of travel - the full amount of fare and charges collected by the Carrier; after commencement of travel - the applicable fare and charges from the point of cancellation to the destination (or the scheduled stopover place) specified in the Reservations Data of the Ticket or Exchange Order as separately stipulated by the Carrier.
    • (3) The Carrier shall extend the period of validity of the unused sector of the Ticket.
  2. In the event that the Carrier is unable to provide some passengers with seats due to overbooking and because the number of passengers (only those who have presented his/her Authentication Code, Ticket or the like, with confirmed reservation, for check-in at a Carrier's airport office by the time stipulated by the Carrier) with valid seat reservations on a flight exceeds the number of available seats on the flight and therefore seats are not available to some passengers, the Carrier shall call for volunteers prepared to surrender their confirmed reservations. In such cases, the Carrier shall make a certain amount of payment stipulated by the Carrier to those volunteers who surrendered their confirmed reservations as a cooperation reward, in addition to any arrangements set forth in paragraph 1 of this Article.

Article 23: Cancellation or Changes for Reasons Other than Those Caused by Carrier or Requested by Passenger

If the Carrier fails to perform a Contract of Carriage, in whole or in part, due to any reasons set forth in paragraph 5 of Article 40, the Carrier shall take any of the steps set forth below at the option of the passenger:

  • (1) If travel has not yet commenced, the Carrier shall perform carriage of the passenger and his/her Baggage on a flight on which seats are available, to the initial destination specified in the Reservations Data of the Ticket or Exchange Order.
    If the destination specified in the Reservations Data of the Ticket or the Exchange Order changes after commencement of the flight, the Carrier shall arrange for carriage to the initial destination specified in the Reservations Data of the Ticket or the Exchange Order for the passenger and his/her Baggage by any of the following means of transportation at the option of the Carrier.
    • (a) on a flight of the Carrier on which a seat is available.
    • (b) on a flight of another carrier on which a seat is available.
    • (c) by other means of transportation.
      In the cases set forth above, if an amount of fare and charges after the change of flight or rerouting exceeds the amount that would have been refunded for the applicable fare and charges of the original sector, the Carrier shall not collect the difference. If such amount is less than the amount that would have been refunded, the Carrier shall refund the difference.
  • (2) The Carrier shall issue a refund as follows: before commencement of travel - the full amount of the fare and charges collected by the Carrier; after commencement of travel - the applicable fare and charges from the point of cancellation to the destination (or the scheduled stopover place) specified in the Reservations Data of the Ticket or Exchange Order as separately stipulated by the Carrier.
  • (3) The Carrier shall extend the period of validity of the unused sector.

Article 24: Fraudulent Boarding

Any of the acts set forth below shall constitute fraudulent boarding and shall be subject to a charge of double the amount of the highest fare and charges applicable at the time of such fraudulent boarding, in addition to the fare and charges applicable to the passenger for the flight flown under fraudulent boarding, provided that if the sector flown cannot be ascertained, the fare and charges shall be calculated from the place of departure of the flight.

  • (1) Failure to present an Authentication Code or Ticket at the request of the Carrier's personnel in charge, or to board beyond the sector specified in the Reservations Data of the Ticket or the Exchange Order without approval from the Carrier's agent.
  • (2) To board a flight intentionally with an invalid Ticket.
  • (3) To board a flight at a special fare on the basis of a false declaration.

[Section 3: Baggage]

Article 25: Checked and Unchecked Baggage

  1. The Carrier shall, upon presentation by the passenger of a valid Authentication Code or a Ticket, accept as Checked Baggage or acknowledged as Unchecked Baggage, the Baggage tendered by the passenger at the Carrier's airport office by the time stipulated by the Carrier.
  2. In addition to the preceding paragraph, upon requested by a passenger who is scheduled to transfer to a connecting flight of any other carrier (only if the Carrier has entered into a contract regarding carriage of Baggage with such other carrier) departing from the destination of the Carrier's flight, the Carrier shall accept Baggage tendered by the passenger as Checked Baggage for the carriage on the connecting flight of another carrier, if the passenger presents a valid Authentication Code or a Ticket for the Carrier's flight as well as a valid Authentication Code or a Ticket for the connecting flight of another carrier at the Carrier's airport office by the time stipulated by the Carrier.
    In this case, the Carrier shall accept Baggage as Checked Baggage with the consent of the passenger as an agent of another carrier, pursuant to the conditions of carriage of such other carrier. The Carrier shall not deliver the Checked Baggage to the passenger at the destination airport of the Carrier's flight.
  3. The Carrier shall issue a Baggage Identification Tag for the Checked Baggage.

Article 26: Loading of Checked Baggage

The Carrier shall carry the Checked Baggage of a passenger in the same flight as the passenger, provided that the Carrier may, if such carriage is deemed impractical by the Carrier because of the maximum permissible weight or for other reasons, carry the Checked Baggage on any other flight or by any other transportation service on which the Checked Baggage can be loaded.

Article 27: Security Inspection

  1. A passenger shall submit to any security check required by the Carrier, unless it is specifically deemed unnecessary by the Carrier.
  2. The Carrier will inspect the contents of a passenger's Baggage by opening it and/or by any other means in the presence of the passenger or a third person, for the purpose of security (including, but not limited to, the prevention of unlawful seizure, control or destruction of an aircraft) or for any other reasons. Notwithstanding the foregoing, the Carrier may inspect the passenger's Baggage in his/her or a third person's absence to see whether he/she is in possession of, or his/her Baggage contains, any items prohibited or restricted under Article 31.
  3. The Carrier will search any items worn or carried by a passenger by touching the passenger over his/her clothes or worn items or by using any instruments such as a metal detector, for the purpose of security (including, but not limited to, the prevention of unlawful seizure, control or destruction of an aircraft) or for any other reasons.
  4. If a passenger refuses the Carrier's inspection referred to in paragraph 2, the Carrier will refuse to load such Baggage.
  5. If a passenger refuses the Carrier's inspection referred to in paragraph 3, the Carrier will refuse to board such passenger.
  6. If, as a result of the inspection or search set forth in the preceding paragraphs 2 and 3, the Carrier discovers any items of which is prohibited or restricted Baggage under Article 31, the Carrier may forbid the passenger to carry it into the cabin or refuse to load such items, or may take measures for the disposal of such items.

Article 28: Delivery of Checked Baggage

  1. A passenger shall claim and receive his/her Baggage as soon as reasonably possible after it becomes receivable and check the Baggage Identification Tag at the Destination.
  2. The bearer of the Baggage Identification Tag(s) issued to a passenger when his/her Baggage is checked shall be exclusively entitled to accept delivery of the checked Baggage. A passenger should submit his/her Baggage claim stub(s) to the Carrier.
  3. In the event that the passenger receive his/her Baggage pursuant to sub-paragraphs 1 and 2, the Carrier shall not be obligated to verify that the bearer of a Baggage Identification Tag(s) is truly entitled to accept delivery of the Baggage. The Carrier shall not be liable for any damage arising out of or in connection with its failure to verify.
  4. Checked Baggage shall be delivered to the passenger only at the destination specified on the Baggage Identification Tag, provided that if the passenger so requests, Checked Baggage shall be delivered at the place of departure or a stopping place insofar as circumstances permit such delivery.

Article 29: Loss of Baggage Identification Tag

Should a passenger lose his/her Baggage Identification Tag, the Carrier may deliver the Baggage to the passenger in accordance with a procedure separately provided for by the Carrier, only if the Carrier deems the person claiming delivery of Checked Baggage to be duly entitled to such delivery and if the Carrier receives a commitment from such person to indemnify and hold harmless the Carrier from any loss or damage that the Carrier may incur as a result of the delivery of Checked Baggage to such person.

Article 30: Disposal of Undeliverable Baggage

Checked Baggage that remains unclaimed for seven 7 days, calculated from the day following the date of its arrival at the destination, may be disposed of by the Carrier as appropriate. In this case, the passenger shall be liable for any damage and expenses incurred by the Carrier in connection with such disposal.

Article 31: Prohibited or Restricted Baggage

  1. The Carrier shall refuse to accept any of the following as Checked Baggage and Unchecked Baggage, unless specifically permitted by the Carrier.
    • (1) items that may endanger or cause trouble to the aircraft or any person or property on board;
    • (2) firearms, swords and other similar items, and explosives and other ignitable or flammable items;
    • (3) corrosive chemicals and liquids not contained in a suitable container.
    • (4) live animals.
    • (5) dead body.
    • (6) items that are prohibited by applicable laws or regulations, or by governmental requirements, form being loaded into, or transferred by, aircraft.
    • (7) items that exceed the number of pieces, weight or dimensions separately specified by the Carrier.
    • (8) items that are not properly packed or packaged.
    • (9) items that are easily transmuted, wasted or destroyed.
    • (10) other items which the Carrier considers unsuitable for carriage on an aircraft.
  2. The Carrier shall refuse to accept any of the following as Unchecked Baggage.
    • (1) cutting tools.
    • (2) items similar in shape to firearms, swords, and explosives (e.g. pistol-shaped lighters, hand grenade-shaped lighters).
    • (3) other items the Carrier considers as potential weapons (e.g. bats, golf clubs, ice skates).

Article 32: Valuables

Platinum, gold and other precious metals, currency, bank notes, negotiable securities, documentary stamps, jewelry, art works, antiques and other high-value items shall not be accepted as Checked Baggage.

Article 33: Checked Baggage

  1. Baggage that a passenger may check shall satisfy all of the following conditions.
    • (1) the total weight shall not exceed 100 kilograms.
    • (2) the weight of each piece shall not exceed 32 kilograms.
    • (3) the three dimensions of each piece shall not exceed 203 centimeters, and shall be the dimensions that can be stowed in a cargo compartment.
  2. The Carrier shall permit a passenger to check Baggage which exceed the limitations preceding (2) and (3), only if a prior due notice of such Baggage is given to, and a prior permission to such Carriage is granted by, the Carrier. For the Baggage exceeding the free Baggage allowance as described in Article 35, the Carrier shall collect excess Baggage charges as separately stipulated by the Carrier.

Article 34: Unchecked Baggage

  1. Unless otherwise specified, Baggage that a passenger may carry into the cabin shall satisfy all of the following conditions;
    • (1) not more than one piece.
    • (2) the total weight shall not exceed 10 kilograms.
    • (3) the total dimensions shall not exceed 115 centimeters and shall be of the size that can be stowed in an enclosed storage compartment in the cabin or under the seat in front of the passenger.
  2. A passenger may carry into the cabin one piece as a passenger's personal belongings permitted by Carrier's Regulations.
  3. The total weight of the Baggage and a passenger's personal belongings referred in paragraph 1 and 2 above must not exceed 10 kilograms.
  4. Notwithstanding the preceding paragraphs 1 through 3 of this Article, a passenger shall not carry into the cabin any Baggage which Carrier deems cannot be stowed in safety in the cabin.
  5. The Carrier will permit a passenger to carry into the cabin articles not suitable for Carriage in a cargo compartment (such as fragile musical instruments) only if a prior due notice of such article is given to, and a prior permission to such Carriage is granted by the Carrier. Carriage of such Baggage shall be subject to a charge provided in the Carrier's regulations.

Article 35: Free Baggage Allowance

  1. Unless otherwise specifically provided in Carrier's regulations, the total free Baggage allowance of Checked and Unchecked Baggage for each passenger shall be as follows.
    • (1) a passenger paying an economy class fare shall receive a free Checked Baggage allowance of 20 kilograms.
    • (2) in addition to the preceding (1), a passenger shall receive a free Baggage allowance of Unchecked Baggage as described in paragraphs 1 and 2 of Article 34.
  2. The free Baggage allowance prescribed in the preceding paragraph shall not be applicable to non-seat occupying Infant, and his/her Baggage may be deemed as that of the passenger accompanying him/her.
  3. Overweight baggage in excess of the fee Baggage allowance set forth in paragraph 1 of this Article shall be subject to the applicable excess Baggage charge separately stipulated by the Carrier.
  4. In the event that two or more passengers traveling on the same flight check their Baggage at the same time to be carried by the Carrier to the same place, the Carrier may, upon those passenger's request, provide them collectively with a free Baggage allowance equal to the aggregated individual free Baggage allowance in respect of weight.
  5. The Carrier will accept the following items for free and not include them into the free Baggage allowance.
    • (1) a fully collapsible stroller/pushchair, carrying basket and/or a car seat for infants or children passenger's own use.
    • (2) wheelchair and other similar assistive devices for disabled passenger's own use.
    • (3) an eye-assistance, service or hearing-assistance dog accompanying a passenger with a disability to assist such passenger.

Article 36: Pets

  1. The Carrier shall accept the carriage of pets accompanied by a passenger as Checked Baggage. The term "pets" used herein means domesticated small dogs, cats, birds, etc.
  2. The free Baggage allowance set forth in Article 35 shall not apply to the pets specified in the preceding paragraph. The passenger shall pay the Carrier a charge as separately stipulated by the Carrier.

Article 37: Refund of Excess Baggage Charges and Charges for Pets

  1. If a passenger cancels carriage of his/her Baggage by not later than 20 minutes prior to the scheduled departure time, the full amount of the excess Baggage charges and/or charges for pets paid in connection with the canceled carriage shall be refunded.
  2. If a passenger cancels the carriage of his/her Baggage after the time set forth in the preceding paragraph, or a passenger requests to cancel such carriage in the course of carriage, the Carrier shall not refund the excess Baggage charges and/or charges for pets paid for the onward portion of the carriage that has not been flown, except when the Carrier fails to perform the contact of carriage, in whole or in part, for any reasons caused by the Carrier.

Article 38: Excess Value Charges

If the total value of the Baggage of a passenger and his/her personal belongings exceeds 150,000 yen, the passenger may declare such value. Upon such declaration, excess value charge at the rate of 10 yen for each 10,000 yen, or any fraction thereof, in excess of 150,000 yen shall be payable by the passenger.

Article 39: Refund of Excess Value Charges

  1. If a passenger requests to cancel his/her whole journey, the Carrier shall refund the excess value charges collected by the Carrier in connection with such canceled journey.
  2. If a passenger requests to cancel a portion of his/her journey, the Carrier shall not refund any excess value charges, except where the Carrier fails to perform the contract of carriage, in whole or in part, for any reason caused by the Carrier.

[Section 4: Liability]

Article 40: Liability of Carrier

  1. The Carrier shall be liable for any loss or damage arising in connection with the death or wounding of, or any other bodily injury suffered by, a passenger, if the incident or accident which causes such loss or damage takes place on board an aircraft or in the course of embarking or disembarking an aircraft.
  2. The Carrier shall be liable for any loss or damage arising in connection with the destruction or loss of, or damage to, any Checked Baggage or any other article of a passenger of which the Carrier takes custody, if an incident or accident which causes such loss or damage, takes place while such Baggage or article is in the custody of the Carrier.
  3. The Carrier shall not be liable for such loss or damage as provided for in paragraphs 1 and 2 of this Article, if it is proved that the Carrier and/or its Agent(s) have taken necessary measures to avoid such loss or damage or that the Carrier and/or its Agent(s) were prevented from taking such measures. The term "Agent(s)" as used in this chapter means any employee, representative, agent or contractor of the Carrier who assists in the performance of the contract of the carriage.
  4. The Carrier shall be liable for loss or damage arising out of or in connection with the destruction or loss of, or damage to Unchecked Baggage or any other article carried or worn by a passenger only if it is proved that such destruction, loss or damage was caused by the negligence of the Carrier and/or its Agent(s).
  5. The Carrier may, without notice, change the scheduled time of, or cancel, suspend or terminate any flight; change places of departure and/or destination; make emergency landing; limit the number of passengers on board; unload all or part of loaded Baggage; or take any other necessary measures, for any reason beyond the Carrier's control, such as laws or regulations, governmental requirements, security requirements (including, but not limited to, prevention of unlawful seizure, control or destruction of an aircraft), adverse weather, force majeure, labor dispute actions, riots, civil commotions and wars; and the Carrier shall not be liable for any damage arising as a result of taking such measures, unless the Carrier is held liable for such damage pursuant to the preceding four paragraphs in this Article.

Article 41: Indemnity Due to Inherent Defects in Baggage

The Carrier shall not be liable for any loss or damage arising in connection with destruction or loss of, or damage to any Checked Baggage or any other article of a passenger that the Carrier takes custody of, if such damage is caused solely by any inherent defect, inadequate quality or flaw in the Baggage or the article.

Article 42: Contributory Negligence

If the Carrier proves that any damage has been caused by or caused in connection with the willful misconduct or negligence of a passenger, the Carrier shall be exempted from liability to the passenger, in whole or in part, to the extent that such willful misconduct or negligence has caused or contributed to the damage.

Article 43: Passenger's Liability to Carrier

If the Carrier is incurred any damage caused by a passenger's willful misconduct or negligence, or by his/her failure to observe these Conditions of Carriage or any rules or regulations stipulated thereunder, the passenger shall indemnify the Carrier for such damage.

Article 44: Limitation of Liability of Carrier

  1. The Carrier's liability for the carriage of Baggage shall be limited to 150,000 yen per passenger, provided that if the passenger declares a value higher than the amount for the Baggage before the commencement of the carriage and an excess value charge is paid pursuant to the provisions of Article 38, the liability of the Carrier shall be limited to an amount equivalent to such declared value but shall not, under any circumstances, exceed the actual value of the Baggage.
  2. The term "Baggage" as used in the preceding paragraph shall include Checked Baggage, any other article of a passenger that is placed in the Carrier's custody, Unchecked Baggage and any other article carried or worn by the passenger.

Article 45: Time Limitations on Claims and Actions for Baggage

  1. Acceptance by a passenger with no complaint of his/her Checked Baggage or any other article that the Carrier takes custody of shall be prima facie evidence that it has been delivered in good condition.
  2. Any notice of complaint pertaining to damage to Checked Baggage or any other article of a passenger that the Carrier has taken custody of, shall be provided to the Carrier in writing and, if such Baggage or article has been received by the passenger, within seven (7) days from the day after such receipt or, if it has not been delivered to the passenger, within 21 days from the next day on which they should have been received by the passenger.
  3. The Carrier shall not be liable for any damage unless a complaint is filed within the time specified in paragraph 2 of this Article.

Article 46: Exception to Limitation of Liability

The limitation of liability provided for in Article 44 of these Conditions of Carriage shall not be applicable if it is proved that the damage has been caused by the willful misconduct or gross negligence of the Carrier and/or its Agent(s), provided that if such damage is caused by willful misconduct or gross negligence of the Agent(s), it shall also be proved that the damage occurred while the Agent(s) was (were) performing his/her (their) duties.

Article 47: Successive Carriage

  1. If the Carrier issues a Ticket or accepts Baggage as Checked Baggage for carriage of any other carrier, the Carrier shall do so only as an agent acting on behalf of such other carrier.
  2. If the carriage of a passenger is performed successively by more than one carrier, any claim for damage arising from such carriage may be made only against the carrier that performed the carriage that caused the damage. The Carrier shall not, under any circumstances, be liable for any damage to a passenger if the same has arisen from carriage by any other carrier.

Article 48: Change of Carrier

If a passenger holding a Ticket issued by the Carrier changes to another carrier with the consent of the Carrier and boards a flight of such other carrier with the same Ticket, the carriage shall be subject to the conditions of carriage of such other carrier and the Carrier shall bear no responsibility for such carriage.

Article 49: Applicability of These Conditions of Carriage to Carrier's Agent

If it is proved by an Agent of the Carrier that he/she was performing his/her own duties when any damage as set forth in these Conditions of Carriage occurred, the Carrier's Agent may apply to such damage any and all provisions pertaining to exclusion or limitation of liability of the Carrier in these Conditions of Carriage and any rules and regulations under these Conditions.

Supplementary Provisions

Article 1: Date of Effectiveness

  1. These Conditions of Carriage shall come into effect as of February 14, 2025.
  2. Notwithstanding the preceding Paragraph, the provisions set forth in Paragraphs 1 and 2 of Article 22 and Article 34 shall apply to flights boarding on or after April 30, 2025; with respect to flights boarding prior to April 30, 2025 as set forth in Paragraphs 1 and 2 of Article 22 and Article 34, the provisions that were previously in force shall remain applicable.

These Conditions of Carriage shall come into effect as of MAY 19th, 2026.

Article 1: DEFINITIONS

In these Conditions of Carriage,

  • "Applicable Laws" means such laws, cabinet orders and ministerial ordinances and other governmental regulations, rules, orders, demands or requirements of any state or country as will apply to Carriage of a Passenger and/or Baggage to be performed by the Company.
  • "Company(s)" means, collectively or individually, as the case may be, AIRDO Co., Ltd.
  • "Passenger" means any person, except crew members, carried or to be carried in an aircraft with the consent of a Carrier.
  • "Baggage" means such articles, effects and other personal property of a Passenger as are necessary or appropriate for wear, use, comfort or convenience in connection with his/her travel. Unless otherwise specified, it includes both Checked and Unchecked Baggage of the Passenger.
  • "Carriage" means carriage of a Passenger and/or Baggage by air, gratuitous or for reward.
  • "Company's Office" means offices belonging to the Company (including offices within the city and offices at airports), offices of sole agents and other agents authorized by the Company, and the Company's website on the Internet.
  • "Authorized Agency" means a Passenger sales agent appointed by a Carrier to represent the Carrier in the sale of Carriage of Passengers over the services of the Carrier and, if authorized by the Carrier, over the services of any other Carrier.
  • "Company's Regulations" means the Company's rules and regulations, other than these Conditions of Carriage, for Carriage of Passengers and/or Baggage including, but not limited to, the Company's tables of fares, rates and charges.
  • "Flight Coupon" means a coupon in the form recorded in the Company's database that indicates particular places between which the coupon is good for Carriage.
  • "Days" means calendar days including all seven days of the week; provided that, for the purpose of calculating the number of days of a notice period, the day upon which such notice is dispatched shall not be counted and further provided that, for the purpose of determining the period of validity of a Ticket, the day upon which the Ticket is issued, or the flight is commenced, shall not be counted.
  • "Ticket" means the Electronic Ticket, in each case issued and have been recorded in the Company's database by a Carrier or its Authorized Agency for Carriage of a Passenger and/or Baggage, setting forth a portion of the conditions of a contract of Carriage and notices relating thereto and containing Flight Coupon and Itinerary/Receipt pursuant to these Conditions of Carriage.
  • "Rerouting" means any change in a routing, Carrier, flight or period of validity from that originally provided in the duly-issued Ticket which a Passenger presents for Carriage.
  • "Destination" means the ultimate stopping place under a contract of Carriage.
    In the case of a trip which returns to the place of departure, the Destination is the same as the place of departure.
  • "Electronic Miscellaneous Document" means an electronic document issued by a Carrier or its Authorized Agency, requesting issue of an appropriate Ticket or provision of travel services to the person named in such electronic document.
  • "Stopover" means such deliberate interruption of a travel by a Passenger, at a point between the place of departure and the Destination, as is agreed to in advance by the Carrier.
  • "Agreed Stopping Places" means those places, other than the place of departure and the Destination, set forth in a Ticket and/or any Conjunction Ticket issued in connection therewith as scheduled stopping places on the Passenger's route, or shown in Carrier's timetable.
  • "Infant" means a person who has not reached his/her second birthday as of the date of commencement of Carriage.
  • "Carrier" means an air carrier and shall include an air carrier issuing a Ticket and any air carrier that carries a Passenger and/or his/her Baggage under the Ticket or provides or undertakes to provide any other services incidental to such Carriage.
  • "Agent" means any director, officer, employee, agent or contractor of the Company who assists in the performance of the Contract of Carriage.
  • "Child" means a person who has reached his/her second birthday but not his/her twelfth birthday as of the date of commencement of Carriage.
  • "Itinerary/Receipt" means a document or documents forming part of the Electronic Ticket which contains the information such as the itinerary, ticket information, a portion of the conditions of a contract of Carriage and notices relating thereto. This document shall constitute a Passenger's written evidence of a contract of Carriage.
  • "Oversales" means the practice of accepting more reservations than the number of seats available on some flights in order to provide seats that are expected to be available to customers who actually wish to fly.
  • "Unchecked Baggage" means baggage that is not Checked Baggage.
  • "Checked Baggage" means Baggage of which a Carrier takes custody and for which the Carrier issues Baggage Claim Tag.
  • "Baggage Identification Tag" means a document issued by a Carrier solely for the purpose of identification of Checked Baggage and consisting of two portions: the baggage tag portion which is attached by the Carrier to a particular article of Checked Baggage and the Baggage claim stub which is given to the Passenger.
  • "Conjunction Ticket" means a Ticket issued to a Passenger in conjunction with another Ticket which together constitute a single contract of Carriage.

Article 2: APPLICATION OF CONDITIONS

  • (A) (Applicability)
    1. These Conditions of Carriage, to the extent that they are not in conflict with Applicable Laws, shall apply to all Carriage of Passengers and/or Baggage and to all services incidental thereto performed by the Company in accordance with fares and charges published in connection with these Conditions of Carriage.
    2. Should any special agreement be made with respect to a particular provision of these Conditions of Carriage, such special agreement shall apply, notwithstanding the aforementioned provisions.
  • (B) (Posting)
    Passenger fares, Excess Baggage charges, other fees and charges, flight timetables, and other necessary information shall be posted together with these Conditions of Carriage at the Company's Offices and the offices of its authorized agents.
  • (C) (Gratuitous Carriage)
    With respect to gratuitous Carriage, the Company reserves the right to exclude the application of any provisions of these Conditions of Carriage.
  • (D) (Change of Conditions of Carriage or the Company's Regulations)
    To the extent not in conflict with Applicable Laws, the Company may change these Conditions of Carriage and any regulations of the Company that are based on them, provided that the Company gives notice of such changes to these Conditions of Carriage by an appropriate means, such as posting them to the Company's website, reasonably in advance.
  • (E) (Applicable Conditions)
    Any Carriage of Passengers and/or Baggage shall be subject to these Conditions of Carriage and the Company's Regulations in effect as of the date of commencement of the Carriage covered by the first Flight Coupon of the Ticket.
  • (F) (Consent of Passengers)
    Passengers shall be deemed to have acknowledged and given consent to these Conditions of Carriage and the Company's Regulations with respect to the Carriage of Passengers and/or Baggage by the Company.

Article 3: TICKETS

  • (A) (General)
    1. The Company shall issue a Ticket upon receipt of payment of the applicable fares and/or charges as stipulated separately by the Company. At such time, the Passenger shall provide his/her name, telephone number, and other contact information that the Company may use to communicate with the Passenger, as well as any other information specified by the Company. The Company will not issue or reissue a Ticket to the Passenger if he/she fails to pay the applicable fare or charge or otherwise fails to comply with credit arrangements approved by the Company.
    2. The Company will collect a Ticket exchange/reissue service charge each time a Ticket is issued or each time a Ticket is exchanged or reissued as a result of Rerouting at the request of a Passenger, for each Ticket constituting a single Contract of Carriage for the same Passenger, in accordance with the Company's Regulations. Unless otherwise stipulated by Applicable Laws, such service charges are non-refundable.
    3. To be carried, a Passenger must present a valid Ticket that has been issued in accordance with the Company's Regulations and that contains the Flight Coupon for the flight he/she is about to board and all unused Flight Coupons, and the Passenger must comply with any request to provide identification documents. A Passenger shall not be entitled to be carried if the Ticket presented by the Passenger does not fall within the scope of sub-paragraph 6 of paragraph (A) of Article 9.
    4. A Ticket can only be used by the Passenger whose name is on that Ticket, and it cannot be transferred to a third party.
    5. The Company shall not be liable to any person entitled to be carried or to receive a refund for honoring or refunding a Ticket presented by any person other than the person so entitled. If a Ticket is in fact used by any person other than the person who is entitled to be carried, with or without such person's knowledge and consent, the Company shall not be liable for death of or injury to such unauthorized person or for loss, destruction or delay in arrival of, or damage to, such unauthorized person's Baggage or other personal property arising from or in connection with such unauthorized use.
    6. In the event that the Company has evidently published or sold a Ticket at an incorrect fare or charge, and a Passenger has made a reservation or purchased a Ticket for that fare or charge, the Company reserves the right to cancel or refund the reservation or Ticket or, at the option of the Passenger, to reissue the Ticket at the correct fare or charge.
  • (B) (Validity of Tickets)
    1. In order for the Company to verify the validity of the Ticket, the Passenger will be required to present his/her Ticket.
    2. A Ticket is valid for Carriage from the airport at the place of departure to the airport at the Destination via the route shown on the Ticket within the specified period set forth in the following sub-paragraph. Each Flight Coupon shall be valid for Carriage on the flight for which a seat has been reserved. If a Flight Coupon is issued without a seat reservation, a seat will be reserved for the Passenger upon his/her application, subject to the conditions of the applicable fare and the availability of seats on the flight. For a Ticket to be valid, it must include information on the location and date of issue.
    3. Unless otherwise stipulated by applicable regulations of the Company, a Ticket's period of validity shall be one year from the date of the commencement of Carriage and the following day if Carriage has commenced, or one year from the Ticket's date of issue and the following day if the Ticket has remained completely unused. If a Ticket involves a Flight Coupon to which any fare having a period of validity that is less than one year applies, such period shall apply only to such Flight Coupon.
    4. The period of validity of an Electronic Miscellaneous Document shall be one year from the date of issue thereof.
    5. A Ticket shall expire at midnight on the date of expiration of the period of validity of the Ticket. Travel using each Flight Coupon may continue beyond the date of expiration of the Ticket if such travel commences prior to midnight thereof, unless otherwise stipulated by the Company's Regulations.
    6. An expired Ticket or Electronic Miscellaneous Document will be accepted for refund in accordance with Article 11 and Article 12.
  • (C) (Extension of Validity)
    1. If a Passenger is unable to travel during a Ticket's period of validity due to any of the following reasons, the Company shall, unless otherwise stipulated by applicable regulations of the Company, extend the period of validity of such Passenger's Ticket to the Company's earliest flight with available seats, without charging an additional fare.
      • (a) The Company has cancelled a flight for which the Passenger holds a seat reservation.
      • (b) The Company was unable to operate the flight according to schedule and without unreasonable delay.
      • (c) The Company failed to operate a flight to the Passenger's place of departure, Destination, or Stopover location.
      • (d) The Company caused the Passenger to miss a connection.
      • (e) The Company was unable to provide a seat on the flight reserved by the Passenger.

      • (a) If a Passenger, after commencing his/her travel, is prevented from traveling during a Ticket's period of validity due to illness, the Company may extend the period of validity of such Passenger's Ticket as described below (provided that such extension is not prohibited by Company's Regulations that apply to the fare paid by the Passenger).
        • (i) With respect to a Ticket of which the period of validity is one year, the Company shall extend the period of validity to a date on which the Passenger is able to resume travel as indicated by a valid medical certificate. If an unused Flight Coupon of a Ticket involves one or more Stopover points, the Company shall, subject to the Company's Regulations, extend the Ticket's period of validity for a period not exceeding three months from the day following the date on which the Passenger is able to resume travel.
        • (ii) With respect to a Ticket of which the period of validity is less than one year, the Company shall, unless otherwise stipulated by applicable regulations of the Company, extend the Ticket's period of validity to a date on which the Passenger is able to resume travel as indicated by a valid medical certificate. In the case of (i) or (ii) above, the Company may extend the period of validity of Tickets of other immediate family members traveling with the Passenger to the same extent.
      • (b) The provisions of (a) above shall not permit an extension of the period of validity of a Ticket belonging to a Passenger who fully recovers from an illness before such period of validity expires.

      • (a)
        • (i) In the event of the death of a Passenger during travel, the Company may waive the minimum number of travel days or extend the period of validity of a Ticket belonging to any person accompanying such Passenger.
        • (ii) In the event of death in the immediate family of a Passenger after he/she commences his/her travel, the Company may waive the minimum number of travel days or extend the period of validity of a Ticket belonging to such Passenger and immediate family members accompanying such Passenger. Any such change shall be subject to the Company's receipt of a proper death certificate. Any such extension shall not exceed 45 days after the day following the date of death.
  • (D) (Flight Coupon Sequence of Use)
    1. The Company will honor Flight Coupons only in accordance with the sequence of travel from the place of departure indicated on the Ticket.
    2. The Company shall recalculate and accept Carriage of a Passenger who possesses a valid Ticket containing a completely or partially unused Flight Coupon who commences or continues his/her travel from any scheduled stopping place, based on the actual itinerary in accordance with the Company's Regulations.

Article4: STOPOVERS

Stopovers may be permitted at any Agreed Stopping Place subject to Applicable Laws and the Company's Regulations.

Article5: FARES AND ROUTINGS

  • (A) (General)
    Fares shall apply only to Carriage from the airport at the place of departure to the airport at the Destination and shall not include ground transportation service within airport areas, between airports, or between an airport and downtown areas, except in cases where the Company's Regulations specifically provide that such ground transportation will be provided by the Company without additional ground transportation charges.
  • (B) (Applicable Fares)
    1. Applicable fares and charges shall be the fares and charges that are published by the Company or by its authorized agents or, if not so published, are calculated in accordance with the Company's Regulations, which, unless otherwise stipulated by Applicable Laws, shall be in effect as of the date of issue and shall be applicable on the date of commencement of Carriage using the Ticket's first Flight Coupon. If the amount collected is not the applicable fare and/or charge, the difference shall be charged to the Passenger or refunded to the Passenger. However, the Company shall not refund the difference in the case of special fares and/or charges for which the Company has stipulated otherwise.
    2. Unless otherwise stipulated by the Conditions of Carriage or the Company's Regulations, a fare guarantees to a Passenger the use of one seat to which such fare applies. Unless otherwise stipulated by the Company's Regulations or approved by the Company, a Passenger shall be limited to one seat on board the aircraft.
    3. The Company shall accept Carriage of one Infant per accompanying Passenger free of charge, provided that the Infant does not use a seat and is accompanied by a Passenger at least twelve years of age.
  • (C) (Routings)
    Unless otherwise stipulated by the Company's Regulations, fares shall apply only to routings published in connection with such fares. If there are more than one routing at the same fare, a Passenger may specify the routing prior to the issue of a Ticket. If the Passenger does not specify the routing, the Company may determine the routing.
  • (D) (Taxes, Fees and Charges)
    Taxes, fees, and charges imposed by a government authority or an airport administrator on a Passenger or on a Passenger's use of services or facilities shall not be included in the published fares and charges, but shall be paid separately by the Passenger. Note that consumption tax (including local consumption tax) is included in that amount.

Article6: RESERVATIONS

  • (A) (General)
    1. A seat reservation shall be confirmed when it is recorded in the Company's reservation system as accepted.
    2. The Company prohibits reservations not intended for actual boarding.
    3. Name Changes are not permitted once the reservation has been confirmed in the Company's reservation system.
    4. The Company may limit or prohibit changes or cancellation of reservations for certain fares.
    5. A Passenger who holds an unused Ticket or Coupon without a seat reservation or who wishes to change a reservation for which a Ticket has been issued shall not be entitled to any preferential rights with respect to making a reservation.
  • (B) (Seat Reservations)
    Applications for seat reservations will be accepted at the Company's Offices from a date specified by the Company. However, this shall not apply if other provisions are stipulated by the Company for Passengers paying special fares.
  • (C) (Time Limits for Issuing Tickets)
    If a Ticket is not issued for a Passenger prior to the time limit specified by the Company for issuing the Ticket, the Company may cancel his/her reservation.
  • (D) (Seat Assignment)
    The Company may, without a prior notice, change the seat specified by a Passenger due to a change in aircraft or for other reasons. Such changes include changes to seat location and seat type.
  • (E) (Service Charge When Seat not Used)
    The Company may require a Passenger who fails to use a reserved seat to pay a service charge in accordance with the Company's Regulations.
  • (F) (Cancellation of Reservations made by the Company)
    1. The Company may, at its own discretion, cancel all or a portion of a Passenger's reservation if the Passenger reserves two or more seats and any of the following apply.
      • (a) The seats are reserved for the same sectors on the same date.
      • (b) The seats are reserved for the same sectors on dates that are in close proximity to each other.
      • (c) The seats are for different sectors on the same date.
      • (d) The Company reasonably deems it impossible for the Passenger to use all the reserved seats.
    2. If a Passenger fails to use a seat reserved on a flight without giving prior notice thereof to the Company, the Company may cancel that Passenger's onward reservations and may ask other Carriers to cancel other flights included in those onward reservations. If a Passenger fails to use a seat reserved on a flight of other Carriers without giving a prior notice thereof to such Carrier, the Company may, upon the Carrier's request, cancel his/her onward reservations thereafter.
  • (G) (Communications Charges)
    A Passenger shall, unless the Company agrees otherwise, bear all telephone and other communication charges incurred in making or canceling a reservation.
  • (H) (Personal Data)
    A Passenger shall agree that his/her personal data will be furnished to the Company by the Passenger or his/her agent and will be retained by the Company and, if the Company deems necessary, will be communicated by the Company to the Company's Offices, to service providers, to government authorities, for the purpose of making reservations for Carriage, for obtaining ancillary services, for use by government authorities, and for any other purpose deemed necessary by the Company to facilitate any travel convenience for the Passenger.

Article7: CHECK-IN

  1. A Passenger should arrive at the location indicated by the Company by the time indicated by the Company. (If no time is indicated, a Passenger should arrive with enough time to complete the check-in and departure procedures before the departure time of the flight.) If a Passenger fails to arrive at the location indicated by the Company by the time indicated by the Company, or has arrived but is unable to depart due to a failure to prepare the documentation needed for departure, then the Company may cancel his/her reservation, but the Company will not delay the flight's departure. The Company shall not be liable to a Passenger for any damages incurred as a result of the Passenger's failure to comply with the provisions of this Article.
  2. A Passenger shall be seated in his/her assigned seat. Switching seats with another Passenger, even if he/she is an accompanying Passenger, is not allowed without the Company's permission.

Article8: INSTRUCTIONS OF THE COMPANY

A Passenger shall comply with the instructions of the Company's Agents and crew members with respect to boarding, disembarking, and/or any other activity as well as locations where the Passenger's Baggage is to be loaded or unloaded.

Article9: REFUSAL AND LIMITATION OF CARRIAGE

  • (A) (Right to Refuse Carriage, Etc.)
    The Company may refuse Carriage of any Passenger or remove any Passenger from a flight, and handle the Passenger's Baggage in the same way, if the Company determines at its reasonable discretion that any of the following circumstances apply.
    1. Such action is necessary for reasons related to flight safety.
    2. Such action is necessary in order to comply with laws and regulations or with an order from a government agency.
    3. The Passenger falls under sub-paragraph 4 or 5 of paragraph (B) of Article 14.
    4. Any of the following apply to the Passenger's conduct, age, mental condition, or physical condition.
      • (a) The Passenger requires special assistance from the Company, and such assistance exceeds legal requirements or would cause an undue burden on the normal operations of the Company.
      • (b) The Passenger causes or is likely to cause discomfort or annoyance to other Passengers.
      • (c) The Passenger causes or is likely to cause harm to the safety or health of himself/herself or other persons.
      • (d) The Passenger causes or is likely to cause harm to the aircraft or physical property.
      • (e) The Passenger hinders the Company's Agents or crew members in the performance of their duties or fails to comply with the instructions given by the Agents or crew members.
      • (f) The Passenger acts in a way that is unlawful, disorderly, obscene, or violent.
      • (g) The Passenger smokes in the airplane cabin. (This applies to the use of all smoking devices.)
      • (h) The Passenger uses a portable telephone, portable radio, electronic gaming system, or other electronic devices in the airplane cabin without the Company's permission.
      • (i) The Passenger is carrying any of the items specified below: weapons (excluding weapons carried by competent officers on duty); gunpowder; explosives; corrosive items; inflammable items; articles that are likely to pose a problem or hazard to the aircraft, to Passengers, and/or to property on board the aircraft; or articles or live animals that are inappropriate for Carriage by aircraft
      • (j) The Passenger has a serious illness or injury.
      • (k) The Passenger has or is suspected of having an infectious disease that poses or is likely to pose a direct threat to the health and safety of the Company's Agents and crew members or other Passengers.
      • (l) The Passenger refuses to take any action required by the Company as a precautionary measure against infectious diseases.
      • (m) The Passenger is deemed to be significantly under the influence of alcohol or drugs.
      • (n) The Passenger is significantly offensive or objectionable to other Passengers due to his/her hygiene.
      • (o) The Passenger is a child or infant under the age of eight and is traveling without a companion.
      Note that in cases where sub-paragraph 4 items (c), (d), (e), or (f) of this Paragraph apply, the Company may take other measures as the Company deems necessary to prevent the Passenger from continuing such behavior. Such measures may include, but are not limited to, restraining the Passenger.
    5. The Passenger has behaved on a previous flight in a manner that falls under sub-paragraph 4 of this Paragraph, and the Company deems that such conduct/behavior might be repeated.
    6. Any of the following applies to the Ticket that the Passenger presents. In such cases, the Carrier can render the Ticket invalid.
      • (a) The Ticket was acquired unlawfully or purchased from an entity other than the issuing Carrier or an authorized agent.
      • (b) The Ticket was reported to be lost or stolen.
      • (c) The Ticket is counterfeit.
      • (d) Any of the Tickets' Flight Coupons has been altered by someone other than the Carrier or an authorized agent.
    7. The person presenting the Ticket cannot prove that he/she is the person whose name appears in the "Passenger Name" box on the Ticket. In such cases, the Company can render the Ticket invalid.
    8. The Passenger fails to pay all or part of the fares, charges, and taxes demanded by the Company in spite of the Company's requests, or the Passenger (or the person purchasing the Ticket) is unlikely to abide by the credit arrangement agreed upon between the Company and that Passenger/person.
  • (B) (Conditional Acceptance for Carriage)
    If the Company carries a Passenger who is at risk of causing danger or harm to himself/herself due to his/her condition, age, mental state, or physical state, the Company shall not be liable for the Passenger's death or for any injury, illness, disability, or aggravation thereof suffered by the Passenger therefrom.
  • (C) (Limitation on Carriage)
    1. Acceptance of Carriage of unaccompanied Infant or Child Passengers, disabled persons, pregnant women, and persons with illness shall be subject to the Company's Regulations and may require a prior arrangement with the Company.
    2. If the total weight of Passengers and their Baggage exceeds the maximum allowance weight with respect to the aircraft, the Company may, in accordance with the Company's Regulations, place restrictions on Passengers or their Baggage.
    3. The Company may refuse to seat a Passenger in an emergency exit row seat and can switch that Passenger to a different seat if any of the following apply, in order to ensure that someone capable of providing assistance in the event of an emergency evacuation is available. In such cases, if special charges determined by the Company have been applied, the Company shall refund the special charges it has collected, and no further charges stipulated by the Company's Regulations shall be collected.
      • (a) The Passenger is under the age of 15.
      • (b) During an emergency evacuation, the Passenger would have difficulty providing assistance or his/her own health would be impaired due to his/her physical condition, health, or other reasons.
      • (c) The Passenger would be unable to understand the evacuation procedures and instructions given by the Company's Agents and crew members.
      • (d) The Passenger does not consent to providing assistance during an emergency evacuation.

Article10: FRAUDULENT BOARDING

  1. Any of the acts set forth below shall constitute fraudulent boarding and shall be subject to a charge of double the amount of the highest fare and charges applicable at the time of such fraudulent boarding, in addition to the fare and charges applicable to the Passenger for the flight flown under fraudulent boarding, provided that if the sector flown cannot be ascertained, the fare and charges shall be calculated from the place of departure of the flight:
    • (a) failure to present a Ticket at the request of Agent and crew member of the Company or to board beyond the sector specified in the reservation without approval from Agent and crew member of the Company;
    • (b) to board a flight intentionally with an invalid Ticket; or
    • (c) to board a flight at a special fare on the basis of a false declaration.

Article11: REFUNDS

  • (A) (General)
    1. Unless otherwise stipulated by Applicable Laws, in the event that a Passenger fails to use his/her Ticket or a portion thereof, the Company shall, at the Passenger's request, provide a refund for the unused Ticket or portion thereof in accordance with this Article and the Company's Regulations. The provisions of this Article that apply to Tickets also apply to Electronic Miscellaneous Documents.
    2. According to the Company's Regulations, the Company may limit or refuse to provide refunds for Tickets, depending on the fare.
  • (B) (Person to whom Refund will be made)
    1. Unless otherwise stipulated by this Paragraph, the Company shall provide a refund to either the person named on a Ticket or to the person who purchased the Ticket upon presentation to the Company of satisfactory evidence that he/she is entitled to a refund.
    2. If the Ticket was purchased by credit card, the Company shall provide a refund to the credit card company that issued such credit card.
    3. The Company shall provide a refund if all unused Flight Coupons and the Itinerary/Receipt are surrendered to the Company.
    4. Any refund made to a person who surrenders to the Company all unused Flight Coupons and the Itinerary/Receipt and claims a refund pursuant to sub-paragraph 1 or 2 of this Paragraph shall be deemed a valid refund and shall discharge the Company from liability to provide any further refund to the person so entitled.
  • (C) (Refund Period)
    Fares and charges shall not be refundable once 30 days have elapsed since the day following the expiration of a Ticket's period of validity.
  • (D) (Right to Refuse Refund)
    The Company will not provide a refund for a Ticket in the event that the Passenger is refused Carriage or is removed from a flight in accordance with sub-paragraphs 6 and/or 7 of Paragraph (A) of Article 9.
  • (E) (Refund by the Company)
    Unless otherwise stipulated by the Company's Regulations, the Company will provide a refund for the Passenger's convenience only if the Ticket was originally issued by the Company or an authorized agent.

Article12: REROUTING AND REFUNDS REQUESTED BY PASSENGER

  • (A) (Rerouting)
    1. The Company may limit or prohibit Rerouting, depending on the fare.
    2. Upon a Passenger's request, the Company shall effect a Rerouting with respect to an unused Ticket or Flight Coupon if any of the following conditions apply:
      • (a) The Ticket was issued by the Company.
      • (b) The Company is the original issuing Carrier indicated in the "Original Issue" box on the Ticket.
      • (c) If any of the following apply:
        • (i) The Company is the designated Carrier in the "Carrier" box on the unused Flight Coupon for the first sector for which the Rerouting is to be effected.
        • (ii) The Company has been assigned the right to handle the unused Flight Coupon(s) by another Carrier.
        • (iii) No Carrier is designated by the "Carrier" box on the unused Flight Coupon(s).
          However, if the Carrier that issued the Ticket is designated as the Carrier for the first sector and onward sectors for which the Rerouting is to be effected, then the right to handle the unused Flight Coupon(s) must be assigned to the Company by the issuing Carrier, regardless of which of the aforementioned conditions (i), (ii), or (iii) applies.
    3. After Carriage commences, the following rules shall apply.
      • (a) Additional Carriage at the through fare that combines the additional sector of Carriage with the original sector of Carriage shall not be permitted unless a request for such additional Carriage is made to the Company prior to the Passenger's arrival at the Destination indicated on the Ticket.
      • (b) In the event that a new itinerary resulting from a Rerouting does not satisfy the conditions applicable to a round trip discount, the round trip discount shall not apply to those sectors already flown, even if the relevant Ticket was issued on the basis of a round trip discount.
    4. The fares and charges that are applicable after a Rerouting shall be those which would have applied on the date of commencement of Carriage, on the date the Ticket was issued. However, if a Ticket for which a Passenger requested a Rerouting is unused, the fares and charges applicable in accordance with the Company's Regulations may be those fares and charges that are applicable at the time the Rerouting is effected.
    5. The Company shall collect or provide a refund for any difference between the fares and charges that apply after a Rerouting and the fares and charges originally paid by the Passenger. If there is any amount to be refunded, it shall be refunded to the Passenger shall be in accordance with Article 11 and Paragraph (B) of this Article.
    6. The date of expiration of any Ticket newly issued as a result of a change in route, Carrier(s), or flight shall be the same as the date of expiration of the original Ticket. However, if a Passenger requests a Rerouting for an unused Ticket, the applicable date of expiration of the new Ticket shall be calculated on the basis of the date of issue of the Ticket issued after the Rerouting.
    7. Time limits for reservation cancellation and charges related to reservation cancellation and changes shall also apply to any Rerouting effected at the Passenger's request, as stipulated by the Company's Regulations.
  • (B) (Refunds)
    In the event that, in addition to a refund for a Passenger's convenience, a Passenger is refused Carriage or is removed from a flight pursuant to the sub-paragraph 9 of paragraph (A) and is prevented from using Carriage under such Passenger's Ticket, the refund amount shall be as follows.
    1. If no portion of the trip has taken place, an amount equal to the fares and charges paid, minus any prescribed fees stipulated by the Company's Regulations.
    2. If some portion of the trip has taken place, an amount equal to the difference between the fare and charges paid and the fare and charges that apply to the sector(s) for which the Ticket has been used, minus any prescribed fees stipulated by the Company's Regulations.

Article13: INVOLUNTARY REROUTING AND REFUNDS

  • (A) (Schedules)
    1. The Company undertakes to use its best efforts to carry a Passenger and his/her Baggage with reasonable dispatch and to adhere to published schedules in effect on the date of travel. However, the times shown in timetables and published elsewhere are tentative and not guaranteed, and they shall form no part of the contract of Carriage. The Company may change the schedule of any flight without prior notice. The Company shall bear no responsibility for any disruption of a Passenger's or his/her Baggage's connection to another flight as a result thereof.
    2. The Company may, without prior notice, substitute any other Carrier or change an aircraft with respect to Carriage assumed by the Company.
    3. The Company may, without prior notice, terminate, divert, postpone, or delay any flight or any subsequent Carriage or right of Carriage, or cancel any reservation therefor, or determine whether a flight should take off or land. In such cases, the Company shall accept no liability, in accordance with sub-paragraph 3 and 4 of paragraph (B) or sub-paragraph 3 and 4 of paragraph (C) of this Article.
  • (B) (Rerouting and refunds due to Force Majeure Event)
    1. The term "Force Majeure" applies to any of the following.
      • (a) Any fact beyond the Company's control (including, but not limited to, meteorological conditions, acts of God, strikes, riots, protests, embargoes, war, hostilities, civil disturbances, or unstable international relations), whether actual, threatened, or reported, as well as any delays, demands, conditions, circumstances, or requirements directly or indirectly related to such fact
      • (b) Any fact that cannot be foreseen, anticipated, or predicted
      • (c) Applicable Laws
      • (d) A shortage of labor, fuel, or facilities; or labor problems experienced by the Company or other parties
    2. In the event of the following circumstances due to Force Majeure, the Company will, at the Passenger's option, take the measures specified either in sub-paragraph 3 or sub-paragraph 4 below.
      • (a) The Company cancels the flight.
      • (b) The Company fails to operate the flight reasonably according to schedule.
      • (c) The Company fails to stop at the Passenger's Destination or Stopover point.
      • (d) The Company is unable to offer the Passenger a seat on the flight he/she has reserved or causes a Passenger to miss his/her connecting flight for which he/she holds a reservation.
    3. Rerouting
      • (a) The Company shall perform Carriage of the Passenger and his/her Baggage on a flight on which seats are available to the Destination or Stopover point indicated on the Ticket or to airport in the vicinity of such Destination or Stopover point as designated by the Company.
      • (b) In the event of a change of Destination as indicated in the Ticket after departure, the Company shall arrange for Carriage to the Destination or Stopover point as indicated on the Ticket for the Passenger and his/her Baggage by any of the following means, at the Company's option.
        • (i) A flight operated by the Company with an available seat
        • (ii) A flight operated by another Carrier with an available seat
        • (iii) Another mode of transportation
      • (c) In the case of (a) or (b) above, no adjustment for the difference in the fares and charges will be made.
    4. Refunds
      The refund calculation will be performed in accordance with item (i) or (ii) of sub-paragraph 4 of Paragraph (C) of this Article.
  • (C) (Rerouting and refunds for reasons attributable to the Company)
    1. The phrase "reasons attributable to the Company" refers to any reason other than those specified in sub-paragraph 1 of Paragraph (B) of this Article.
    2. In the event of the following reasons attributable to the Company, the Company will, at the Passenger's option, take the measures indicated either in sub-paragraph 3 or sub-paragraph 4 below. However, the Company may handle such transactions on the basis of Paragraph (D) of this Article in accordance with the Company's Regulations.
      • (a) The Company cancels the flight.
      • (b) The Company fails to operate the flight reasonably according to schedule.
      • (c) The Company fails to stop at the Passenger's Destination or Stopover point.
      • (d) The Company is unable to offer the Passenger a seat on the flight he/she has reserved or causes a Passenger to miss his/her connecting flight for which he/she holds a reservation.
    3. Rerouting
      • (a) The Company shall perform Carriage of the Passenger and his/her Baggage to the Destination or Stopover point as indicated on the Ticket by any of the following means, at the Company's option.
        • (i) A flight operated by the Company with an available seat
        • (ii) A flight operated by another Carrier with an available seat
        • (iii) Another mode of transportation
      • (b) In the case of (a) above, no adjustment for the difference in the fares and charges will be made.
      • (c) In the event that a Passenger misses a connecting flight operated by the Company for which the Passenger holds a reservation because another Carrier carrying the Passenger fails to operate its flight according to the schedule or changes the schedule of such flight, the Company shall not be liable for such missed connection.
    4. Refunds
      In the event that a Passenger is refused Carriage or is removed from a flight pursuant to any of sub-paragraphs 1 through 5 of Paragraph (A) of Article 9, other than for reasons attributable to the Company as stipulated in this Paragraph, and the Passenger is unable to receive Carriage via a Ticket belonging to the Passenger, then the refund amount for the Ticket shall be as follows.
      • (a) If no portion of the trip has taken place, an amount equal to the fare paid
      • (b) If a portion of the trip has taken place, the difference between the fare paid and the fare that applies to the sector(s) for which the Ticket has been used
  • (D) (Limitation of Carriage for oversales)
    In the event that the Carrier is unable to provide some passengers with seats due to oversales and because the number of passengers (only those who have presented his/her Ticket or the like, with confirmed reservation, for check-in at a Carrier's airport office by the time stipulated by the Carrier) with valid seat reservations on a flight exceeds the number of available seats on the flight and therefore seats are not available to some passengers, the Carrier shall call for volunteers prepared to surrender their confirmed reservations. In such cases, the Carrier shall make a certain amount of payment stipulated by the Carrier to those volunteers who surrendered their confirmed reservations as a cooperation reward, in addition to any arrangements set forth in paragraph 1 of this Article.

Article14: BAGGAGE

  • (A) (Restriction of Acceptance as Baggage)
    1. The Company will refuse to accept the following items as Baggage:
      • (a) Items which do not constitute Baggage as defined in Article 1
      • (b) Items which may endanger the aircraft or any person or property, such as items which are specified by the Dangerous Goods Regulations of the International Civil Aviation Organization (ICAO) and the International Air Transport Association (IATA), and in the Company's Regulations
      • (c) Items for which Carriage is prohibited by laws and regulations
      • (d) Items which the Company deems unsuitable for Carriage by reason of their weight, size, shape, or properties, such as being fragile or perishable
      • (e) Live animals, excepting those provided for in Paragraph (J) of this Article
      • (f) Human remains
      • (g) Firearms, swords, and similar items, except as otherwise stipulated in the Company's Regulations
      • (h) Other items which the Company considers unsuitable for Carriage on an aircraft
    2. The Company will refuse to accept the following items as Unchecked Baggage:
      • (a) Items that resemble firearms, swords, and explosives (e.g., lighters shaped like guns or hand grenades)
      • (b) Other items the Company considers to be potential weapons (e.g., baseball bats, golf clubs, and ice skates)
    3. The Company will refuse Carriage of items for which Carriage as Baggage is prohibited under preceding sub-paragraphs 1 and 2 of this Paragraph and may take any necessary action upon discovery thereof. The Company may also refuse forward Carriage of such items upon discovery.
    4. The Company will refuse to accept as Checked Baggage fragile or perishable items; money; jewelry; platinum, gold, and other precious metals; negotiable securities; securities; bank notes; documentation stamps; works of art; antiques and other valuables; business documents; passports and other documents necessary for travel; and samples.
    5. The Company may refuse to accept Baggage as Checked Baggage if it is not properly packed in a suitcase or other suitable container, in order to ensure safe Carriage using ordinary handling methods.
    6. If any item specified in sub-paragraph 1 or 2 of this Paragraph is brought on board, regardless of whether or not Carriage of such item as Baggage is prohibited, the charges, limitations of liability, and other provisions applicable to Carriage of Baggage as specified in these Conditions of Carriage shall apply.
  • (B) (Security Inspection)
    1. Passengers and Baggage shall be subject to security checks unless such checks are specifically deemed unnecessary by the government, airport officials, or the Company.
    2. The Company shall inspect the contents of Baggage by opening it or by some other method in the presence of the Passenger or a third party for the purpose of aviation security (including the prevention of unlawful seizure, exercise of control, or destruction of the aircraft) and/or for other reasons. The Company may also inspect a Passenger's Baggage without the presence of the Passenger or a third party in order to see whether the Passenger is in possession of, or if his/her Baggage contains, any prohibited item referred to in sub-paragraphs 1 and 2 of Paragraph (A) of this Article.
    3. The Company will inspect the articles of clothing and other items worn by the Passenger by touching the Passenger on top of his/her clothing and apparel or by using a metal detector or similar device, for the purpose of security (including the prevention of unlawful seizure, exercise of control, or destruction of aircraft) and/or for other reasons.
    4. If a Passenger does not comply with the inspection described in sub-paragraph 2 of this Paragraph, the Company will refuse to carry such Passenger's Baggage.
    5. If a Passenger does not comply with the inspection described in sub-paragraph 3 of this Paragraph, the Company will refuse to carry such Passenger.
    6. If prohibited items as specified in sub-paragraphs 1 and 2 of Paragraph (A) of this Article are found as a result of the inspections specified in sub-paragraphs 2 and 3 of this Paragraph, the Company may refuse to carry or allow on board such Baggage and may dispose of such Baggage.
  • (C) (Checked Baggage)
    1. Unless otherwise stipulated by Applicable Laws or the Company's Regulations, the Company will, upon presentation by a Passenger of a valid Ticket for Carriage solely for the Company's sector(s) or for sector(s) of the Carrier and sector(s) of another Carrier, accept as Checked Baggage the Baggage that is tendered by the Passenger at the office specified by the Company by the time prescribed by the Company for Carriage on the sector(s) specified on the Ticket. However, the Company will not accept Baggage as Checked Baggage in the following cases:
      • (a) The Baggage is tendered for Carriage beyond the Destination indicated on the Ticket or for Carriage via a route not indicated on the Ticket.
      • (b) The Baggage is tendered for Carriage beyond the Stopover point or beyond a point at which the Passenger will transfer to a connecting flight departing from a different airport from the one at which the Passenger is scheduled to arrive according to his/her Ticket, unless otherwise stipulated by the Company's Regulations.
      • (c) The Baggage is tendered for Carriage beyond the point of transfer to another Carrier with whom the Company has no interline Baggage Carriage Agreement or whose Conditions of Carriage differ from those of the Company.
      • (d) The Baggage is tendered for Carriage in a sector for which the Passenger holds no reservation.
      • (e) The Baggage is tendered for Carriage beyond the point at which the Passenger desires to resume possession of such Baggage or any portion thereof.
      • (f) The Baggage is tendered for Carriage in a sector for which the Passenger has not paid all applicable charges.
    2. Upon receipt of the Checked Baggage, the Company will record in the Company's database the number of pieces and weight of the Checked Baggage and will issue a Baggage Identification Tag for each piece of Checked Baggage.
    3. If a piece of Checked Baggage has no name, initials, or other personal identification, the Passenger should affix such identification to the Baggage prior to the Company's acceptance of the Baggage for Carriage.
    4. The Company will, to the reasonable extent possible, carry Checked Baggage on the same aircraft that the Passenger who entrusted the Baggage to the Company has boarded. However, if the Company deems doing so to be difficult, the Company may carry the Checked Baggage on any other flight that has sufficient allowable loading capacity or may convey it by some other means of transportation.
    5. The Company will accept Checked Baggage in excess of the following limits only if the Company is notified in advance by the Passenger and agrees to provide Carriage.
      • (a) The total of the greatest outside length, greatest outside height, and greatest outside width (hereinafter referred to as the "sum of three dimensions") of each piece shall not exceed 203 centimeters (80 inches), and it must be capable of being stowed in the cargo compartment of the aircraft on which it is loaded.
      • (b) The weight of each piece shall not exceed 32 kilograms (70 pounds).
      • (c) The total weight for all Checked Baggage shall not exceed 100 kilograms (220 pounds).
      If the Company does accept such Carriage, charges shall be assessed in accordance with the Company's Regulations. However, the Company will not accept Carriage of any piece of Baggage the sum of three dimensions of each piece of which exceeds 292 centimeters (115 inches) and/or the weight of which exceeds 45 kilograms (100 pounds).
  • (D) (Unchecked Baggage)
    1. Except as otherwise specified, the Company shall permit each Passenger to carry on board, in addition to personal belongings as specified in the Company's Regulations and kept in the Passenger's custody (provided that the sum of three dimensions does not exceed 115 centimeters [45 inches]), Baggage as specified in the Company's Regulations, within the following limits.
      • (a) Not more than one piece
      • (b) Not exceeding 10 kilograms (22 pounds) in weight
      • (c) Unchecked Baggage shall not exceed 115 centimeters (45 inches) or, in the case of an aircraft with a seating capacity of less than 100 passengers, 100 centimeters (39 inches), and it must be capable of being stowed in an enclosed storage compartment in the cabin or under the seat in front of the Passenger.
    2. The Company permits each Passenger to carry on board only one item of personal belongings as specified in the Company's Regulations.
    3. The total weight of the Baggage and the Passenger's personal belongings referred to in sub-paragraphs 1 and 2 above must not exceed 10 kilograms.
    4. Notwithstanding preceding sub-paragraphs 1 through 3 of this Paragraph, a Passenger shall not carry into the cabin any Baggage that the Company deems cannot be safely stowed in the cabin.
    5. The Company will permit a Passenger to carry into the cabin articles not suitable for Carriage in a cargo compartment (such as fragile musical instruments) only if sufficient prior notice is given and permission is granted by the Company in advance. Carriage of such Baggage shall be subject to a charge as specified in the Company's Regulations.
  • (E) (Free Baggage Allowance)
    1. The total free Baggage allowance for each Passenger is based on the Company's Regulations. The free Baggage allowance is shown on the Itinerary/Receipt. In addition, Unchecked Baggage shall be free of charge as specified in sub-paragraph 1 of Paragraph (D) of this Article.
    2. The free Baggage allowance described in the preceding sub-paragraph shall not apply to an Infant who is not occupying a seat, and such Infant's Baggage shall be deemed to be the Baggage of the accompanying Passenger.
    3. In the event that two or more Passengers traveling on the same flight check their Baggage at the same time to be carried by the Company to the same place, the Company may, upon those Passengers' request, provide them collectively with a free Baggage allowance equal to the aggregated individual free Baggage allowance with respect to the number of pieces.
    4. Foldable strollers, portable bassinets, and child seats for use by Infant and Child Passengers, and wheelchairs to be used by Passengers with disabilities, are accepted as Checked Baggage for free and are not included into the free Baggage allowance.
  • (F) (Special Free Baggage Allowance)
    In addition to the free Baggage allowance specified in the preceding paragraph, the Company will carry as Baggage, without additional charge, a Passenger's personal belongings as permitted by the Company's Regulations only when the Passenger carries and retains them.
  • (G) (Excess Baggage)
    1. When accepting Carriage of Checked Baggage as specified in sub-paragraph 5 of Paragraph (C) of this Article, the Company will charge the applicable excess Baggage charge specified in the Company's Regulations for Baggage in excess of the free Baggage allowance specified in sub-paragraph 1 of Paragraph (E) of this Article.
    2. Unless prior arrangements have been made, the Company may carry Baggage that is in excess of the applicable free Baggage allowance on any other flight operated by the Company or another Carrier or by any other means of transportation.
      • (a) The payment or refund of excess Baggage charges in the event of a Rerouting made for the Passenger's convenience shall be made in accordance with sub-paragraph 5 of paragraph (A) of Article 12.
      • (b) In the event of cancellation of Carriage, a refund of excess Baggage charges shall be made in accordance with sub-paragraph 1 of paragraph (B) of Article 12.
      • (c) In the event of a rerouting or cancellation of Carriage for reasons other than a request from the Passenger, a payment or refund of excess Baggage charges shall be made in accordance with sub-paragraphs 3 and 4 of paragraph (B) of Article 13 and sub-paragraphs 3 and 4 of paragraph (C) of Article 13.
    3. If a Passenger cancels Carriage of his/her Baggage by the time prescribed by the Company's Regulations, the full amount of the applicable excess Baggage charge for the cancelled sector(s) shall be refunded.
  • (H) (Declaration of Baggage the Value of which Exceeds the Limit of Liability and Excess Value Charges)
    1. A Passenger may declare a value of Baggage in excess of liability limitations specified in sub-paragraph 5 of Paragraph (C) of Article 18. In the event that such declaration is made, Carriage of the Baggage to be performed by the Company shall be subject to excess value charges. In such cases, the Company shall charge an excess value charge at a rate of 10 yen for every 10,000 yen of excess value.
    2. Unless otherwise stipulated in the Company's Regulations, a Passenger may pay excess value charges at the place of departure for travel to the Destination. However, if a portion of the Carriage is performed by any other Carrier that applies different excess value charges than those applied by the Company, the Company may refuse to accept an excess value declaration with respect to such portion.
    3. If the entire travel segment is cancelled, the Company will refund the entire excess value charge collected for the cancelled segment. If a portion of the Carriage has already been completed, the Company will not refund the excess value charge. If a portion of the Carriage has already been completed, the Company will not refund the excess value charge.
  • (I) (Collection and Delivery of Baggage)
    1. A Passenger shall, at his/her own responsibility, check the number on his/her Baggage Identification Tag(s) upon arrival at the Destination or Stopover point and collect his/her Checked Baggage. The Company may require the Passenger to present his/her Baggage Claim Stub(s) at the time of Baggage collection.
    2. The bearer of the Baggage Claim Stub(s) issued to a Passenger when his/her Baggage is checked shall be exclusively entitled to accept delivery of the checked Baggage. The Company shall not be obligated to ascertain that the bearer of a Baggage Claim Stub(s) is truly entitled to accept delivery of the Baggage. The Company shall not be liable for any damages arising out of or in connection with its failure to so ascertain.
    3. In the event that a Passenger is unable to receive his/her Baggage pursuant to the preceding sub-paragraph, the Company will deliver the Baggage to such person only if he/she establishes to the Company's satisfaction that he/she is duly entitled to receive the Baggage. In addition, the Passenger must also provide the Company with adequate assurance that he/she indemnifies the Company from any loss or damages incurred by the Company in connection with such delivery, if asked to do so by the Company.
    4. The Company may, unless precluded by Applicable Laws and regulations, and if time and other circumstances permit, deliver Checked Baggage to the bearer of a Baggage Claim Stub(s) at his/her place of departure or an unscheduled stopping place if he/she requests such delivery.
    5. Acceptance of delivery of Baggage by the bearer of a Baggage Claim Stub without an objection stated in writing by the Passenger at the time of the delivery shall constitute prima facie evidence that the Baggage has been delivered in good condition and in accordance with the Contract of Carriage.
    6. If Checked Baggage remains unclaimed for a considerable period of time after its arrival at the Destination, the Company may dispose of the Baggage as appropriate. In such cases, the Passenger shall be liable for any damages or expenses incurred in connection with such disposal.
  • (J) (Animals)
    1. The Company will accept Carriage of domesticated animals such as dogs, cats, household birds, and other pets that are placed in an appropriate container by the Passenger in accordance with the Company's Regulations.
    2. In the event that the Company accepts Carriage of an animal, the animal shall, together with its container and food to be carried, not be included in the Passenger's free Baggage allowance. For Carriage of such animal, the Company will charge a fee as stipulated by the Company's Regulations.
    3. The preceding sub-paragraph notwithstanding, a service dog accompanying a Passenger with a disability to assist such Passenger together with a container and food shall, in accordance with the Company's Regulations, be carried for free and shall not be included in the free Baggage allowance.
    4. The Company will accept Carriage of an animal subject to the condition that a Passenger shall observe the Company's Regulations and shall be fully responsible for such animal. The Company shall not be liable for injury to, sickness or death of, such animal if and to the extent that such event results from the inherent nature of such animal. If the animal inflicts damages upon the Company or other Passengers, the Passenger shall be liable for the costs related to such damages.

Article15: GROUND TRANSPORTATION SERVICE

Unless otherwise specified in the Company's Regulations, the Company will not arrange for, operate, or provide ground transportation services within airport areas, between airports, or between an airport and downtown areas. Unless provided directly by the Company, ground transportation services will be provided by other transportation operators, who shall not be an Agent or deemed an Agent of the Company. The Company shall not be liable for any act or omission by a transportation operator even if an officer or Agent of the Company assists the Passenger in arranging ground transportation. In the event that the Company operates a ground transportation service for Passengers, the Company's Regulations, including those stated or cited in connection with Tickets and the value of Baggage, shall be deemed applicable to such ground transportation service. The Company will not refund any portion of the fare even if the Passenger does not use such ground transportation service.

Article16: ARRANGEMENTS MADE BY THE COMPANY

In the event that the Company arranges accommodations or other services incidental to Carriage by air for a Passenger, the Company shall not be liable for any loss or damages suffered or expenses incurred by the Passenger as a result of such accommodations or other services or arrangements, whether or not the Company bears the expenses incurred in connection with such accommodations or other services or arrangements.

Article17: SUCCESSIVE CARRIERS

  1. Carriage provided successively by more than one Carrier under a Conjunction Ticket shall be treated as a single operation, and Carriers other than the Company shall be referred to as successive Carriers.
  2. Even if the Company is the issuing Carrier of the Ticket or is designated as the Carrier for the first sector on the Ticket or on any Conjunction Ticket involving Carriage by successive Carriers, the Company shall not be responsible for any sector operated by another Carrier, unless otherwise stipulated in these Conditions of Carriage.
  3. The liability of individual Carriers for damages arising in connection with a Passenger's travel shall be governed by the Conditions of Carriage of the individual Carriers.

Article18: LIABILITY OF CARRIER

  • (A) (Applicable Laws)
    1. All Carriage and other services provided by the Company shall be subject to the provisions of the following:
      • (a) Applicable Laws
      • (b) These Conditions of Carriage and the Company's Regulations (which can be inspected at any of the Company's Offices)
    2. The full name of a Carrier and its abbreviation shall be as set forth in that Carrier's regulations, and such name may be expressed in an abbreviated form on Tickets.
  • (B) (Death and bodily injury of Passengers)
    1. The Company shall be liable for compensation for any loss incurred in the event that a Passenger dies, is wounded, or experiences bodily injury, if the accident or incident causing such loss occurs on board an aircraft or during operations to board or disembark from an aircraft.
    2. The Company shall not be liable for compensation if it is proved that the Company and/or its Agents took necessary measures to prevent such loss or were prevented from taking such measures.
  • (C) (Damage to baggage)
    1. The Company shall be liable for compensation for damages in the event of destruction, loss, or damage to Checked Baggage, if the incident causing such destruction, loss, or damage occurs on board an aircraft or while the Baggage is in the custody of the Company.
    2. The Company shall not be liable for compensation if it is proved that the Company and/or its Agents took the necessary measures to prevent damage to Checked Baggage or were prevented from taking such measures.
    3. The Company shall be liable for compensation for damages arising out of or connected with the destruction, loss, or damage to Unchecked Baggage and other property carried or worn by a Passenger only if the Company and/or its Agents are proved to have been negligent.
    4. The Company shall not be liable for any damage to Unchecked Baggage not attributable to the fault of the Company. Assistance rendered to a Passenger by Agent and crew member in loading, unloading or transshipping Unchecked Baggage shall be considered as a gratuitous service for the Passenger.
    5. The Company's liability for Baggage shall be limited to 150,000 yen per Passenger.
    6. The limit specified in the preceding sub-paragraph shall be raised to a higher declared value if the Passenger declares a higher value in advance and pays an excess value charge in accordance with Paragraph (H) of Article 14.
    7. In no event shall the Company's liability under any of sub-paragraphs 1, 3, 5 or 6 of this Paragraph exceed the actual loss suffered by the Passenger and the actual value of such Baggage. All claims shall be subject to proof by the Passenger of the amount of damages.
    8. The Company shall not be liable for compensation for damages arising out of or connected with the destruction, loss, or damage to Baggage or any other property of a Passenger in the Company's custody if such damage is caused solely by an inherent defect, quality, or flaw in such Baggage or property, regardless of whether or not the Company had knowledge of the existence of such Baggage or property.
    9. The Company shall not be liable for any damage to a Passenger's Baggage caused by the contents thereof. A Passenger whose property causes damage to another Passenger's Baggage or the property of the Company shall indemnify the Company for all loss and expenses incurred by the Company as a result thereof.
    10. The Company may refuse to accept any article that does not qualify as Baggage under these Conditions of Carriage. However, if such articles are accepted by the Company, the Company's limitations on the value of Baggage and limitations of liability shall apply to such articles, and such articles shall be subject to fees charged by the Company.
  • (D) (Limitation of Liability)
    1. The limitations of liability stipulated in this Article shall not be applicable if it is proved that the damage has been caused by the willful misconduct or gross negligence by the Company and/or its Agents. However, in the case of willful misconduct or gross negligence by an Agent, it must also be proved that he/she was performing his/her duties when the damage occurred.
    2. The Company will issue Tickets and accept Baggage for a sector of Carriage performed by another Carrier only as an agent of such Carrier. The Company shall not be liable for any damage that occurs outside a sector of Carriage performed by the Company. The Company shall neither be liable for any damage that occurs to Checked Baggage outside a sector of Carriage performed by the Company.
    3. If the Company proves that the Passenger's negligence or wrongful act or omission caused or contributed to the damage when the Company receives the claim, the Company shall be exempted from liability to the claimant in whole or in part, to the extent that such negligence or wrongful act or omission caused or contributed to the damage.
    4. The Company shall not be liable for any damage directly or indirectly arising out of its compliance with any Applicable Laws, failure of a Passenger to comply with the same, or any cause beyond the Company's control.
    5. The Company shall not be liable for any indirect damage or special damage arising out of Carriage performed in accordance with these Conditions of Carriage and the Company's Regulations, regardless of whether or not the Company had foreseen the possibility of such damage.
    6. If the Company incurs any damages caused by a Passenger's willful misconduct or negligence or by his/her failure to observe these Conditions of Carriage or any rules or regulations stipulated thereunder, the Passenger shall compensate the Company for such damages.
    7. If, in the event of a change of Carrier with the Company's consent, a Passenger boards a flight in a sector of another Carrier on a Ticket issued by the Company, such Carriage shall be subject to the Conditions of Carriage of such other Carrier, and the Company shall not be liable in any respect for such Carriage.
    8. Except as stipulated in these Conditions of Carriage, the Company reserves all rights of defense permitted by Applicable Law. The Company also reserves a right to make a subrogation claim against a third party that contributes to damages with respect to all or a portion of any payment made by the Company in connection with such damages.
    9. All provisions of these Conditions of Carriage and the Company's Regulations related to exclusion or limitation of the Company's liability shall apply to any of the Company's officers and Agents in the performance of their duties, and to the owner of any aircraft used by the Company for Carriage, as well as that owner's employees in the performance of their duties. The aggregate amount of the damages payable by the Company's Agents shall not exceed the amount of the Company's limitation of liability under these Conditions of Carriage.

Article19: TIME LIMITATIONS ON CLAIMS AND ACTIONS

No claim for damage may be made in the case of damage to Baggage, unless the person entitled to delivery complains to an office of the Company forthwith after the discovery thereof and no later than 7 Days after the date of receipt (excluding the date of receipt); and, in the case of delay or loss, unless the complaint is made no later than 21 Days after the date (excluding such date) on which the Baggage has been (in the case of delay) or should have been (in the case of loss) placed at his/her disposal. Every complaint must be in writing and dispatched within the time aforesaid.

Article20: GOVERNING LAW AND JURISDICTION

  1. These Conditions of Carriage shall be construed in accordance with the laws of Japan, and any matter not provided for in these Conditions of Carriage shall be subject to the laws of Japan.
  2. Any dispute arising out of, or in connection with, these Conditions of Carriage shall be subject to the exclusive jurisdiction of Japanese courts and legal proceedings therefor shall be governed by the laws of Japan, no matter who is entitled to claim for damages or what the legal basis for such claim is.

Article21: CLASS ACTION WAIVER

To the extent not in conflict with Applicable Laws, any lawsuit brought by a Passenger against the Company will be brought only in the Passenger's individual capacity, and may not be brought in or asserted as part of a class action proceeding.

Article22: OVERRIDING LAW

Any provision contained or referred to in a Ticket or in these Conditions of Carriage or the Company's Regulations shall, even if it is in violation of Applicable Laws and is invalid, remain valid to the extent not in conflict with Applicable Laws. The invalidity of any provision shall not affect any other provision.

Article23: MODIFICATION AND WAIVER

No Agent of the Company shall have authority to alter, modify or waive any provision of the contract of Carriage or of these Conditions of Carriage or the Company's Regulations.

Supplementary Provisions
